1. Introduction
Welcome to the official website of GRADIN Machinery (hereinafter referred to as “The Company”, “We”, “Us”, or “Our”). By accessing this website, requesting a quotation, or placing an order for our lifting equipment, you agree to be bound by the following Terms and Conditions. Please read them carefully before proceeding.
2. Products and Specifications
We strive to ensure that the technical specifications, dimensions, and descriptions of our hydraulic lifts, aerial work platforms, and other machinery are accurate. However, due to our policy of continuous improvement:
We reserve the right to modify specifications without prior notice to improve performance.
Customized Orders: For customized equipment, the final manufacturing will be strictly based on the technical drawings confirmed and signed by the Buyer.
3. Orders and Contract
Quotation: All quotations provided by GRADIN are valid for 30 days unless otherwise stated.
Order Confirmation: A contract is formed only when the Buyer receives a formal Proforma Invoice (PI) from us and pays the advance deposit.
Cancellation: Once production has commenced for customized orders, cancellations are not accepted. Standard orders may be cancelled subject to a restocking fee.
4. Pricing and Payment Terms
Currency: All prices are quoted in US Dollars (USD) or Euros (EUR) unless agreed otherwise.
Payment Methods: We primarily accept T/T (Telegraphic Transfer) and Irrevocable L/C (Letter of Credit) at sight.
Standard Terms: Typically, a 30%-50% deposit is required to start production, with the balance to be paid before shipment or against the copy of the Bill of Lading (B/L), depending on the agreed Incoterms.
5. Shipping and Delivery
Incoterms: We operate according to Incoterms 2020 (EXW, FOB, CIF, DDP, etc.).
Lead Time: Production lead times are estimates (usually 15-30 days). While we make every effort to deliver on time, GRADIN shall not be liable for delays caused by Force Majeure, shipping carrier delays, or customs clearance issues.
Inspection: The Buyer is responsible for inspecting the goods upon arrival. Any visible damage to the packaging must be noted on the delivery receipt immediately.
6. Warranty Policy
GRADIN provides a 12-month standard warranty for all main structures and key components (hydraulic cylinders, motors, pumps) from the date of receipt.
Coverage: We will provide free replacement parts and technical guidance for defects caused by manufacturing quality.
Exclusions: The warranty does not cover damages resulting from improper operation, lack of maintenance, overloading, or unauthorized modifications.
7. Intellectual Property
All designs, technical drawings, images, and content displayed on this website or provided during the customization process are the intellectual property of GRADIN Machinery. They may not be copied, reproduced, or distributed without our written consent.
8. Limitation of Liability
To the maximum extent permitted by law, GRADIN shall not be liable for any indirect, incidental, or consequential damages (including loss of profit) arising from the use or inability to use our equipment. Our total liability shall not exceed the purchase price of the specific product.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the People’s Republic of China. Any disputes arising out of these terms shall be resolved through friendly negotiation or submitted to the competent court in Jinan City.
